These terms govern your use of ennmart.com, the En Mart app and the En Mart Seller app (the “Services”), operated by En Mart, 4/465 Ground Floor, Kurinji Nagar Formerly Known as TV Nagar, Thanakkankulam, Madurai, Madurai, Tamil Nadu, 625006 (“En Mart”, “we”, “us”). By creating an account or using the Services you agree to these terms and to our Privacy Policy.

1. About En Mart

En Mart is an online marketplace. Independent sellers list and sell products to buyers through the Services. Unless stated otherwise on a listing, the seller is responsible for the product, its description, quality, legal compliance and fulfilment. En Mart provides the platform, payment collection and support.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract under Indian law.
• Give accurate information and keep it up to date.
• Keep your password and OTPs private. You are responsible for activity on your account.
• Tell us at once at ennmartsupport@gmail.com if you suspect unauthorised use.

3. Buying on En Mart

• Prices: prices shown are in Indian Rupees and include applicable taxes unless stated otherwise. Delivery charges, if any, are shown before you pay.
• Orders: placing an order is an offer to buy. An order is confirmed when payment succeeds and the seller accepts it. We or the seller may cancel an order (for example, if an item is unavailable or mispriced) and will refund any amount paid.
• Payments: payments are processed by Razorpay and are subject to its terms.
• Delivery: delivery times shown are estimates.
• Cancellations, returns and refunds: you can cancel an order free of charge until the seller ships it. Because most products on En Mart are food, items cannot be returned for a change of mind. If an item arrives damaged, spoiled, expired or tampered with, or is wrong or missing, report it with photos within 48 hours of delivery at ennmartsupport@gmail.com or on WhatsApp, and we will arrange a replacement or refund. Refunds are processed within 5–7 business days of approval. Approved refunds are paid to the original payment method.

4. Selling on En Mart

• Registration: seller accounts are activated only after En Mart reviews the business details provided, including GSTIN, PAN and, where required, FSSAI licence.
• Listings: every listing is reviewed before it goes live. En Mart may approve, ask for changes, put on hold or reject a listing. Some details (such as product name, category, quantity, unit and main image) cannot be changed after approval.
• Compliance: you are responsible for making sure your products, labels, prices (MRP) and descriptions comply with applicable laws, including food safety, legal metrology, consumer protection and tax laws, and that you have the right to sell them.
• Commission and payouts: En Mart charges a commission on each sale at the rate shown in the Seller app. Payouts, net of commission and any lawful deductions, are made to the bank account registered in your seller profile.
• Fulfilment: you must ship accepted orders on time and in the condition described.

5. What you must not do

• List or buy illegal, counterfeit, unsafe or prohibited products.
• Post false, misleading or infringing content, or fake reviews.
• Use the Services for fraud, or to harass or harm anyone.
• Interfere with, probe or overload our systems, or access them by automated means without permission.
• Create accounts using someone else's identity or business details.

6. Reviews and content

You keep ownership of content you upload (such as reviews and product images) and give En Mart a non-exclusive, royalty-free licence to use, display and adapt it to operate and promote the Services. We may remove content that breaks these terms or the law.

7. Intellectual property

The En Mart name, logo, apps and website are owned by En Mart or its licensors. You may not copy or use them without our written permission.

8. Third-party services

The Services use third-party providers such as Razorpay and Google. Their terms and privacy policies apply to your use of their services.

9. Disclaimers and liability

We work to keep the Services available and accurate, but they are provided “as is” and may sometimes be interrupted. To the extent permitted by law, En Mart is not liable for indirect or consequential losses, and our total liability for any claim relating to an order is limited to the amount paid for that order. Nothing in these terms limits your rights under the Consumer Protection Act, 2019.

10. Indemnity

You agree to compensate En Mart for losses arising from your breach of these terms or of the law, including (for sellers) claims relating to your products or listings.

11. Suspension and termination

We may suspend or close an account that breaks these terms or the law, or to protect users. You can close your account at any time. See Delete Account. Orders, payments and payouts already in progress will be completed or settled.

12. Governing law

These terms are governed by the laws of India. Courts at Madurai have exclusive jurisdiction, subject to your rights to approach consumer commissions under the Consumer Protection Act, 2019.

13. Changes

We may update these terms. The date at the top shows when they last changed. Continuing to use the Services after a change means you accept it.
